Somavera Terms of Service

Welcome to Somavera (“Somavera,” “we,” “us,” or “our”), a fictitious business name of Nutrean, LLC (“Nutrean”). By accessing or using this website (the “Site”) or purchasing our products or services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Site.

These Terms apply to users of the Site, including browsers, customers, and subscribers.

 

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to purchase products or enter into a subscription with Somavera. By placing an order or enrolling in a subscription, you represent that you meet this requirement and that the information you provide is accurate and complete.

 

2. Products and Services

Somavera offers personalized dietary supplements with formulations selected based on dietary and other information provided by the customer.

Information, analyses, recommendations, and other content provided through the Site are for general informational and educational purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition or to substitute for professional medical advice, diagnosis, or treatment.

Somavera's dietary analysis and personalization are based on information provided by the customer and the methods used by Somavera. Individual nutritional needs may vary, and personalized results should not be understood as a clinical assessment or guarantee of a particular health outcome.

You should consult an appropriate healthcare professional regarding questions about your individual health, medical conditions, medications, or whether a dietary supplement is appropriate for you.

Somavera may modify, update, or discontinue products or services from time to time, subject to any obligations applicable to existing orders or subscriptions.

 

3. Subscription Terms

Somavera products are offered on a subscription basis and automatically renew until canceled or paused in accordance with the Somavera Subscription Policy.

By enrolling in a subscription, you authorize recurring charges to the payment method associated with your subscription and agree to maintain accurate and current payment, contact, and shipping information.

Your subscription, including automatic renewal, cancellation, skipping, pausing, recurring orders, failed payments, fulfillment, and other subscription-related matters, is subject to the Somavera Subscription Policy, which is incorporated into these Terms by reference.

If there is a conflict between these Terms and the Somavera Subscription Policy concerning a subscription-specific matter, the Somavera Subscription Policy will control with respect to that matter.

 

4. Billing and Payments

You agree to provide accurate and current payment information and to pay all charges associated with your orders and subscription, including applicable taxes.

By placing an order and enrolling in a subscription, you authorize Nutrean, LLC, doing business as Somavera, and its payment service providers to charge the payment method associated with your subscription for your initial order and subsequent recurring orders in accordance with the Somavera Subscription Policy.

Available payment methods are displayed at checkout.

If a payment cannot be successfully processed, Somavera or its payment provider may retry the payment in accordance with the Somavera Subscription Policy. Orders will not be fulfilled unless the applicable payment has been successfully processed.

 

5. Shipping and Delivery

Somavera currently ships to the locations described in the Somavera Shipping Policy. Standard shipping is included at no additional charge.

Fulfillment times, estimated carrier transit times, tracking, shipping-address requirements, and procedures for lost, delayed, missing, or undeliverable shipments are described in the Somavera Shipping Policy.

Delivery estimates are not guaranteed and may be affected by carrier delays, weather, holidays, and other circumstances outside Somavera's reasonable control.

The Somavera Shipping Policy is incorporated into these Terms by reference.

 

6. Returns, Refunds, and Order Cancellations

Because each Somavera order is prepared specifically for the individual customer, orders generally cannot be canceled, returned, or refunded once fulfillment has begun.

If fulfillment has not yet begun, Somavera may be able to cancel an order and issue a full refund.

If you receive a product that is incorrect, damaged, or defective, or if Somavera has made an error in fulfilling your order, Somavera will provide an appropriate replacement, refund, or other remedy at no additional cost to you.

Additional terms regarding cancellations, returns, refunds, exchanges, and delivery-related issues are provided in the Somavera Return and Refund Policy, which is incorporated into these Terms by reference.

If there is a conflict between these Terms and the Somavera Return and Refund Policy concerning a return, refund, or order-cancellation matter, the Somavera Return and Refund Policy will control with respect to that matter.

 

7. Dietary Information and Personalization

Somavera uses dietary and other information you provide to generate a nutritional analysis and select a personalized supplement formulation.

The accuracy and usefulness of your analysis and personalization depend in part on the accuracy and completeness of the information you provide. You are responsible for providing accurate information when completing Somavera's dietary analysis and for updating information when appropriate.

Somavera's analysis and personalization use algorithmic methods to estimate dietary intake and identify potential nutritional needs. They are not clinical assessments, diagnostic tests, or guarantees of your actual nutrient status or individual nutritional requirements.

Information and recommendations provided through the analysis are for general informational and educational purposes and are not a substitute for professional medical advice, diagnosis, or treatment.

The collection, use, and handling of information you provide are governed by Somavera's Privacy Policy.

 

8. Intellectual Property

The Site and its content and materials, including text, graphics, images, logos, product descriptions, analyses, questionnaires, software, design elements, and other content made available by Somavera, are owned by or licensed to Nutrean, LLC, doing business as Somavera, and are protected by applicable intellectual property laws.

Subject to these Terms, Somavera grants you a limited, personal, non-exclusive, non-transferable right to access and use the Site for your own personal, non-commercial use.

You may not copy, reproduce, distribute, modify, publish, create derivative works from, sell, license, reverse engineer, or commercially exploit the Site or its content except with Somavera's prior written permission or as otherwise permitted by applicable law.

Nothing in these Terms transfers to you any ownership right in Somavera's intellectual property or that of its licensors.

 

9. User Conduct

You agree to use the Site only for lawful purposes and in accordance with these Terms.

You may not:

  • violate any applicable law or regulation;

  • infringe the rights of Somavera or any third party;

  • interfere with or disrupt the security, operation, or functionality of the Site or its systems;

  • attempt to gain unauthorized access to the Site, accounts, systems, or data;

  • introduce malicious code or otherwise attempt to compromise the Site;

  • use automated means to scrape, extract, or access Site content or data except as permitted by Somavera or applicable law;

  • misuse or attempt to manipulate Somavera's dietary analysis, personalization systems, or other Site functionality; or

  • use the Site for fraudulent, deceptive, or unlawful purposes.

Somavera may restrict or terminate access to the Site for violations of these Terms, subject to applicable law.

 

10. Disclaimers

To the fullest extent permitted by applicable law, the Site and its content, analyses, recommendations, and services are provided on an “as is” and “as available” basis. Somavera does not warrant that the Site will be uninterrupted, error-free, or free from harmful components.

Somavera does not guarantee that its dietary analysis or personalization will identify every nutritional need, precisely reflect your actual nutrient status, or produce any particular health or wellness outcome. Individual nutritional needs and responses to dietary supplements may vary.

Except as expressly stated in these Terms or other applicable Somavera policies, and to the fullest extent permitted by applicable law, Somavera disclaims warranties regarding the Site and services, whether express, implied, or statutory.

Nothing in this section excludes or limits warranties, rights, or remedies that cannot lawfully be excluded or limited.

 

11. Limitation of Liability

To the fullest extent permitted by applicable law, Nutrean, LLC, doing business as Somavera, and its officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Site, services, analyses, or products.

To the fullest extent permitted by applicable law, Somavera's total liability arising out of or relating to any product, order, subscription, or use of the Site or services will not exceed the amount you paid to Somavera for the product, order, or subscription giving rise to the claim.

These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

 

12. Privacy

Somavera's collection, use, disclosure, and handling of personal information are described in the Somavera Privacy Policy.

By using the Site or providing information to Somavera, you acknowledge that your personal information will be handled as described in the Privacy Policy and in accordance with applicable law.

 

13. Changes to These Terms

Somavera may update these Terms from time to time. Changes will apply prospectively, and the “Last Updated” date at the top of these Terms will be revised accordingly.

When required by applicable law, Somavera will provide advance notice of material changes and obtain any consent required before those changes take effect.

Changes specifically affecting subscription terms are also subject to the Somavera Subscription Policy.

 

14. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Site, Somavera products or services, or your purchases or subscription will be governed by the laws of the State of California, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.

Nothing in this section deprives you of any protections afforded to you by laws that cannot be waived by agreement.
